Migoa provides an online booking platform for holiday accommodation that allows (i) access to the Customer with information of properties that are made
available to the public (online or offline) by third parties (whether property owners, “Owners”, property managers, hereafter the “Property Managers”- or
partner portals or affiliates, the “Partners”), and (ii) the formalization and payment, either through the Migoa website, or through the website of the
Partners of whom the accommodation corresponds to, as chosen by the client . (Hereinafter, the “Services”).
These services are solely available for people of 18 and over. Consequently, it is forbidden for an individual of under 18 to use Migoa’s services,
ensuring that Migoa has no responsibility in the case that a minor does use its services. The use of the services implicates that the client has
recognition of this and declares to be over the minimum age.
The use of the Reservation Service requires a full understanding and acceptance by the Customer of the General Terms of Migoa, the Special Terms of Migoa
and, where appropriate, for each specific case, the Terms and Conditions of the owners and / or property managers and / or Partners.
Migoa reserves the right to modify unilaterally, at any time without prior notice, the terms and conditions of subscription and service contracted at
www.migoa.com website and the Special Terms of Migoa. The Special Terms of Migoa stated at all times on the website of Migoa shall be those applicable at
the time of a booking.
To use the Services, you must have accepted the Termsof Migoa.
2. Migoa services
The Services are provided by Migoa through an online platform that allows customers to access information on accommodation, create favourite lists, make
reservations and post comments on accommodation (hereinafter, the “Comments”). Migoa is not acting in any way or at any point as part of the contracted
reservation, but only as an intermediate facilitator for them. Migoa is not a property manager or real estate agent or a representative or agent of the
Owners and / or Property Managers and / or Partners. Migoa only makes available to the Customer the information created and provided by the Owners,
Property Managers and Partners, who are responsible for the accuracy of the content accessed by a Customer. Migoa has no control or rights over the
contents and therefore accepts no responsibility for them. All intellectual property rights, copyright or other rights on the content belong to the Owners
and / or Property Managers and / or the Partners, so Migoa is not responsible for their validity, legality, ownership or legitimacy, or any consequences or
claims under such circumstances.
The making of a booking by the Client implies the birth of a contractual relationship between them and the Owner and / or Property Manager and / or the
Partners, but never between them and Migoa.
Customers can post comments on Migoa’s website to give their opinion on the quality, service and standard of accommodation. These comments cannot contain
any form of advertisement or commercial offers. Comments must be done in a respectful way that follows the standard rules and does not compromise the
honour and reputation of individuals. Migoa is not responsible for the content of the comments and reserves the right to modify, reject or delete comments
it deems appropriate. The Customer expressly authorizes Migoa to use the Comments and publicly communicate them for the purpose it deems appropriate
The information provided by Migoa belongs to the Owners and / or Property Managers and / or the Partners, who are solely responsible for its veracity,
accuracy and the availability of the accommodation.
The customer acknowledges and agrees that Migoa is not responsible for any content made available to the Customer, or for any errors that may exist in
them, or the variations or modifications made.
Customer acknowledges and agrees that Migoa is not responsible for the quality, condition, location, availability, ownership, size, capacity, services,
access, packaging, quality and other characteristics of housing, or the availability thereof at the time of reservation with liability being in all cases
applicable solely and exclusively to the Owners and / or Property Managers and / or Partners.
The Customer, upon reservation, assumes all and any possible risk from the quality, condition, location, availability, ownership, size, capacity, services,
access, packaging and other characteristics of the accommodation, and any event on the availability thereof in the reservation dates.
Customer agrees that in case of filling any complain in respect of accommodation, quality, condition, location, availability, ownership, size, capacity,
services, access, packaging, availability, or any other circumstances relating to such accommodation should direct that complaint to the owner and / or
Property Manager and / or Partner, and in no case to Migoa either joined or alternative.
4. Reservation procedures
The use of Reservation Service (hereinafter the “Reservation”) by the Customer is the birth of a contractual relationship between them and the Owner and /
or Property Manager and / or Partner.
4.1. Procedure for booking accommodation owners and / or Property Managers
The use of the accommodation booking service of a property coming from Owner and / or Property Manager constitutes acceptance by Customer of the terms and
conditions of contracting of the Owner and / or Property Manager, in particular regarding cancellation policies, to be provided on request for the
of the reservation will vary depending on the terms and conditions of each Owner and / or Property Manager, always with submission to the principles set
out in these Conditions of Migoa.
In any case, the Customer is informed of the specific conditions of payment for each case that may involve the completion of either a single payment for
the full price of multiple payments, either all at Migoa through the platform or the payment referred to in clause 5.1.
Once the Customer has requested the Reservation by clicking on the “Book Now” Migoa requires the Owner and / or Property Manager
to confirm the booking as soon as possible and start the payment procedure described in Clause 5. Within 24 hours of the Customer’s request, Migoa will
notify the Customer about confirmation (hereinafter the “Confirmation”) or non-confirmation of the Reservation, including in such notice full details of
If a Customer, after starting the procedure of booking through the link “Book Now” does not make the required payment or the data
provided for the payment are incorrect or the data is not validated following verification process as provided in clause 5.1, the Reservation will be
cancelled and the Customer must restart the reservation process.
4.2. Procedure for accommodation booking through Partners
The booking procedure, in the case of accommodation coming from Partners, will be held in accordance with the terms and conditions of contracting of
Partner, which the Customer must accept at the time of initiating the procedure of booking in such accommodation.
5. Payment Procedure
The payment procedure in the case of accommodation coming from Owners and / or Property Managers will be held as provided in clause 5.1.
5.1. Procedure for payment of accommodation owners and / or Property Managers
The application of the Reservation by Customer will require initial payment of the total sum or part of it, as Customer was informed in each case,
depending on the terms and conditions of each Owner and / or Property Manager .
All payments that are to be made through the website of Migoa – this is, in all cases the first payment and, where appropriate, the form of payment must be
done by one or all of the following payment methods Paypal, credit card, bank transfer and any other payment method that is incorporated. Migoa has an
agreement with an online payment platform which will therefore will require access to billing information (name, tax identification number, ID number,
address) and data from the credit card provided by the Customer, who has to provide them with the information to proceed with the authorization of payment
and give Migoa access to such data in order to meet the price indicated in the Reservation. When the customer is redirected to the website of the payment
Customers provide billing and credit card data for the approval of Migoa in their sole discretion for:
Obtain prior authorization for the full amount of the booking even before communicating to the Owner or Property Manager, as appropriate. In case
the outcome of the request for prior authorization is negative due to lack of sufficient available funds or any other reason, Migoa may reject the
Charge the Customer’s credit card the symbolic amount of 1 Euro or equivalent amount in other currencies to verify the authenticity of the credit
card. This amount will be refunded to the customer after verifying the authenticity of the card.
Acceptance of the Special Conditions of Migoa and the facilitation of the Customers billing data and bank details imply the authorization for Migoa to
charge the credit card with the Reservation made by the Customer, either directly through Migoa platform or any other platform contracted via Migoa, in one
or more instalments, as communicated in the specific conditions of each Reservation.
Migoa cannot control the commissions or fees that the bank may charge to the Customer as a result of the payment corresponding to the client’s reservation
either by credit card or bank transfer, so Migoa shall in no way be liable in respect of such commissions or fees without limitation.
Payments are made in currencies other than euro can be charged with the corresponding exchange costs.
The charges corresponding to each Reservation will include the taxes which legally apply in the moment of the Reservation.
5.2. Lodging Partner Payment Procedure
The payment procedure in the case of accommodation coming from Partners, will be made according to the terms and conditions of the contracted Partner,
which Customer must accept at the time of initiating the procedure for the Reservation for that accommodation.
The Customer is incurred to the Owner and / or Property Manager and / or Partner’s is responsible to leave the accommodation in the same condition as it
was upon arrival. The Customer is obliged to immediately notify the Owner and / or Property Manager and / or Partner about any damage that occurs in the
accommodation during their stay in it. Migoa, in its function as third party to the contractual relationship between Customer and the Owner and / or
Property Manager and / or Partner, has no involvement or role in this issue.
Owners and / or property managers and / or Partner may require Customers, at the time of arrival at the accommodation, the provision of a deposit
(hereinafter, the “Deposit”), to cover any damage caused to housing by the Customer during their stay. The amounts and conditions of such Deposit shall be
communicated to the Client prior to the completion of the Reservation, and its characteristics depend on the terms and conditions of each Owner and / or
Property Manager and / or Partner.
Migoa disclaims any responsibility and ability of intermediation of (i) any damage caused to the accommodation during the stay of the Customer and any
complaints by them, (ii) repairing the damage, (iii) payment of the Deposit and (iv) return of the Deposit to the Client by Owner and / or Property Manager
and / or Partner. Any payment to be made to repair any damage will be handled directly by the Owner and / or Property Manager and / or Partner with the
Customer, without the intermediation of Migoa.
7. Cancellations, amendments and refunds
The use of the Services by the Client constitutes acceptance of the cancellation and refunds policy stated under this clause and the conditions established
in each case in the terms and conditions of the Owner and / or Property Manager and / or Partner to whom the property is attributed in the specific
7.1. Cancellations, amendments and refunds on the Reservation of Owners and / or Property Managers accommodation
If the Client cancels a booking after the completion of the first payment, depending on the terms and conditions of the Owner and / or Property Manager,
these terms could be a refund of the first payment or equal to zero.
To cancel a booking, the Customer must do so by accessing the link which appears on the email confirmation of the Reservation.
If the Customer wants to change the terms of a Reservation upon receiving the Confirmation and after making the first payment, they may do so under the
terms and conditions established by each Owner and / or Property Manager, addressing it directly to the Owner and / or Property Manager, without any
intervention from Migoa, at the address they were given upon receiving the confirmation of the Reservation. In any case, the modification of the
reservation shall be the equivalent of a new booking.
If the Reservation does not get confirmed, or in the case of a cancellation of the Reservation due to reasons attributable solely to the Owner and / or
Property Manager, the Customer will be entitled to a refund of their total payments in a reasonable timescale.
7.2. Cancellations, amendments and refunds on the Reservation of Partner accommodation
Cancellations, amendments and refunds on the Reservation of the Partners accommodation will be made according to the terms and conditions of contracting
the Partner, which Customer must accept at the time of initiating the procedure of Reservation in such accommodation.
8. General Conditions
In cases not covered in the provisions of the Special Conditions of Migoa the General Conditions of Migoa shall apply at all times, the Customer must
accept the General Condition prior to the acceptance of Special Conditions.
